NOTICE OF OPPORTUNITY FOR COMMENT

Proposed Amendments to the
Maine Rules of Professional Conduct
to prohibit attorneys from engaging
in sexual relations with clients 

Comments due by 4:00 p.m. on Monday, October 15, 2018
Public Hearing on Tuesday, October 23, 2018, at 1:30 p.m.

The Maine Supreme Judicial Court invites comments on a proposal to amend the Maine Rules of Professional Conduct to prohibit a lawyer from engaging in sexual relations with a client unless a consensual sexual relationship existed between them when the client-lawyer relationship commenced.  The proposed amendment is available here.

Any comments must be filed with the Clerk of the Supreme Judicial Court by 4:00 p.m. on Monday, October 15, 2018.  Comments may be in writing, mailed to the address below, or in an email sent to lawcourt.clerk@courts.maine.gov.  If the comments are in an attachment to the email, the attachment must be a document in portable document format (.pdf).  The Clerk's Office will acknowledge receipt of the email via reply email.

All comments must contain (1) the name and mailing address of the individual submitting the comments, and (2) the name, mailing address, and primary telephone number of the organization (if any) on whose behalf the comments are submitted.  An individual need not be an attorney to submit comments individually or on behalf of an organization.

Comments are public documents and may be posted on the Court's website.

The Court will accept oral comments on this proposal, along with oral comments on another pending proposal to amend the Maine Rules of Professional Conduct to prohibit discrimination and harassment, at the public hearing already scheduled on Tuesday, October 23, 2018, at 1:30 p.m., in the Supreme Judicial Courtroom of the Cumberland County Courthouse in Portland.
