This topic was presented May 6, 2017 at the Maine State Bar Association's Elder Law and Estate Planning Institute.

The cottage/camp co-ownership conundrum. It goes without saying that each estate planning client and family is unique, and his or her “heritage” real estate is no exception. Occasionally that client will have an overwhelming desire to keep “Tara” in the family. But real property succession often unearths plantation-sized planning, tax, familial, and long-term care risk challenges. Explore trusts, FLPs, LLCs, QPRTs, CRTs, conservation easements and other tools and techniques to pass the family real estate to the kids without dismembering the family.
