Parental Rights of Nonparenting Grandparents, De Facto Parents and Legal Guardians was presented at the 2015 Family Law Institute.

Maine Courts have addressed the rights of third parties regarding contact with and control of children in three distinct areas outside of the child protection proceedings. One such area is grandparents’ visitation rights under the Grandparents’ Visitation Act. Also, through the equitable power of the Family Court certain parental rights have been extended to what have been referred to as de facto parents. Finally, third parties have also gained rights to children through guardianship proceedings under the Maine Probate Code. This session will examine: the development of the case law around the Grandparent Visitation Act; that portion of the newly enacted Maine Parentage Act that deals with the de facto parents, as well as the prior case law of de facto parenthood; and the guardianship statutes and case law. The session will be a practical analysis of when and how a third party can acquire “parental rights” to a child who is not his or her biological child, short of proving jeopardy in the child protection realm.
