Litigation Holds: Triggering Events, Scope of Hold, and Consequences for Failing to Preserve  Evidence

What is my client’s obligation to preserve evidence? What is my obligation as outside counsel? What happens if evidence is not preserved? This program will answer these questions and more, focusing on the litigation hold obligation and explaining how best to comply with it under the law. Pierce Atwood attorney Katherine Kayatta will discuss what types of events can trigger a party’s duty to preserve evidence – sometimes such events are obvious, but often they are not. The program will also address how a party should determine what evidence to hold and preserve, and how to manage the preservation process, as well as what types of information should be included in a litigation hold notice and to whom such a notice should be distributed. Finally, the program will cover what steps parties should take once litigation is complete and the consequences of failing to preserve evidence.
