Improper Attorney-Client Relations: Sex With Clients (and Other Really
Dumb Things to Do)

In this webinar, Professor Mark Yochum parses ABA Model Rules 1.7(a) and 1.8(j). In doing so, he attempts to answer for the ultimate issue faced by lawyers who find themselves developing romantic feelings for a client -- when does the lawyer's love interest create a significant riskĀ of a material limitation on the relationship? And while the answering this hypothetical question deals with a special corner of evil, it provides instruction about the larger issue of conflicts of interests embodied in Rules 1.7, 1.8, 1.9 and 1.18. And therefore, while very few lawyers will ever deal with this particular conflict (hopefully), it can serve as a memorable vehicle to remind lawyers of the less salacious (but no less damaging) conflicts of interest that ensnare many lawyers.

Mark Yochum, J.D. is Professor of Law at Duquesne, specializing in bankruptcy and professional responsibility. Over the last three decades, he has presented or organized over 200 continuing legal education programs for the Allegheny County Bar Association, the National Conference of Bankruptcy Judges, the Internal Revenue Service and many others. He launched Duquesne University School of Law's continuing legal education program and coordinated CLE programming from 1993 to 2012. Professor Yochum is not only known for his substantive expertise but his flair for the dramatic. He has been involved in more than 60 regional theater productions. Moreover, he has emceed more than 75 events for the law school, bar associations, and charitable groups.
