There are many considerations for lawyers to factor into their relationship with elderly clients. Diminished capacity, vulnerability, fiduciary service and undue influence of others often come into play when the Maine lawyer is advising an elderly client. This session, which is based on Maine law and court rules, will provide an overview of how Maine practitioners address these challenging concerns and offer solutions to other participants in their own practice. The panelists will also discuss what resources they turn to and or rely on when tackling the more difficult issues surrounding representation of this client population.
